What In A Mark?

Often business owners enter the market and to be identified or to make their presence felt in the market. One way of doing so is having a particular identity to be different from the rest of their competitors. It is more so apparent for those who truly believe that their products or services have special features and offer better quality than those existing in the market. However, there are also “riders” who want to enjoy the benefit of well known products or services by trying to identify hemselves as the same as those well known brands.

A trademark is typically a name, word, phrase, logo,symbol, design, image, or a combination of these elements. A trade mark helps to identify the source and those responsible for the products and services sold in the market. Trademarks serve to identify a particular business as the source of goods or services.

Building a reputation for one’s business is a long journey. Once that reputation – business identifiable with the products or services – is established, it is unfair for others to claim that reputation. As such the most prudent thing for any business owners to do is to register the business trade mark. Trademarks are used to claim exclusive properties of products or services. Once a trademark is registered it confers a bundle of exclusive rights upon the registered owner, including the right to exclusive use of the mark in relation to the products or services for which it is registered.





As soon as the trademark is registered, any attempts by any party; and of course competitors; to use similar trademark for his benefits without the owner’s consent, amounts to an infringement of the trademark. The owner of a trademark may pursue legal action against trademark infringement to protect the business from any untoward consequences of consumers’ confusion. We may simply call it as brand protection.

People may ask when is the best time to protect their brand? Well, the sooner the better! You may not realize the potential of your products or services until it is well accepted in the market. By then, someone might have registered the trademark as his. So, wait no more.

Trademark is on the other hand, may also serve as an incentive for manufacturers, providers or suppliers to consistently provide quality products or services to maintain their business reputation.
